Under the Safe Drinking Water Act (SDWA), primacy is the responsibility for ensuring that a law is implemented, and also the authority to enforce a law and related regulations (40 CFR 142.2). A primacy agency has the primary responsibility for administrating and enforcing regulations. Under Section 1413 of the SDWA, states, U.S. territories, and Indian tribes that meet certain requirements (such as setting regulations that are at least as stringent as EPA's) may apply for, and receive, primary enforcement authority. The requirements for State Primacy are stated in Part 142, Subpart B.
